Freight Forwarder vs Customs Broker: What's the Difference?

A freight forwarder organizes the physical movement of your cargo — booking space with carriers, consolidating shipments, and coordinating the route from origin to a Chilean port. A customs broker (agente de aduana in Chile) handles the regulatory side: classifying your goods, calculating duties and VAT, and filing the import declaration with Chile's Servicio Nacional de Aduanas. In Chile, these two roles are legally separate, unlike in some other markets where one company can hold both licenses.

If you're shipping to Chile for the first time, this distinction matters because Chilean law requires that import declarations be filed by a licensed agente de aduana — a freight forwarder alone cannot legally clear your cargo through customs, no matter how experienced they are in logistics.

What a freight forwarder actually does

A freight forwarder is your logistics coordinator. Depending on your contract, their scope typically includes:

  • Booking ocean (FCL or LCL) or air freight capacity with carriers.
  • Issuing house transport documents such as a house bill of lading.
  • Consolidating cargo from multiple shippers into a single container when you don't need a full container.
  • Coordinating door-to-door movement, including inland transport once the cargo clears Chilean customs.
  • Advising on which Incoterm fits your transaction and negotiating freight rates on your behalf.

A good forwarder also acts as your single point of contact when something goes wrong mid-transit — a missed transshipment, a carrier delay, or a documentation mismatch — rather than leaving you to chase the shipping line directly.

What a customs broker (agente de aduana) actually does

In Chile, only a licensed agente de aduana can legally represent an importer before the Servicio Nacional de Aduanas. Their responsibilities include:

  • Classifying your goods under the correct tariff code (código arancelario).
  • Calculating the ad valorem duty and 19% VAT owed on the CIF value of your shipment.
  • Preparing and filing the Declaración de Ingreso (DIN), the formal import declaration.
  • Taking legal responsibility, jointly with the importer, for the accuracy of that declaration.
  • Handling any physical inspection (aforo) requested by Aduanas before release.

This is a regulated profession in Chile: an agente de aduana must hold a government-issued license, which is why a customs agent is mandatory for most imports, and a general logistics company cannot simply add "customs clearance" to its service list without that credential.

Why the distinction matters for your import to Chile

For a business shipping into Chile, the practical implications are:

  • Liability sits in two different places. Your forwarder is liable for the cargo's safe, timely movement. Your customs broker is jointly liable with you for the accuracy of the customs declaration — errors there can trigger fines or shipment holds independent of anything the forwarder did.
  • Combined service simplifies coordination. Many companies operating in Chile, Segucargo included, provide both freight forwarding and work directly with licensed customs agents, so you have a single point of contact instead of managing two separate vendors and two sets of paperwork.
  • Choosing the wrong provider causes delays. A forwarder without a reliable customs agent relationship — or a customs agent with no visibility into your shipment's transit status — is a common cause of cargo sitting at the port longer than necessary.

How to choose the right setup for your shipment

Before your first shipment to Chile, confirm these points with any provider you're evaluating:

  • Ask whether they work with an in-house licensed customs agent or a trusted external one — and how long that relationship has been in place.
  • Request a breakdown of who is responsible for what at each stage: booking, ocean transit, port handling, customs clearance, and inland delivery.
  • Clarify who communicates with you if customs flags your shipment for physical inspection (aforo) — this should not require you to coordinate between two disconnected parties.
  • For recurring shipments, ask about HS code pre-classification, which speeds up clearance on future imports once your product codes are on file.

For a first-time importer, the safest approach is usually a provider that manages both sides under one coordinated service, so that a transit delay or a documentation question doesn't fall into a gap between two separate vendors.

Can one company be both my freight forwarder and customs broker in Chile?

A company can offer both services, but the customs clearance portion must still be filed by an individual holding a valid agente de aduana license. In practice, forwarders like Segucargo coordinate both functions for you so you deal with a single point of contact.

Do I legally need a customs broker to import into Chile?

Yes, in almost all cases. Chilean regulations require a licensed agente de aduana to file the import declaration (DIN) on your behalf, with limited exceptions for very low-value personal shipments.

Who is liable if my shipment is misclassified?

The importer and the customs broker are jointly responsible for the accuracy of the declaration, including the tariff classification. This is separate from the freight forwarder's liability, which covers the physical transport of the goods.
